Terms of Service

1. What the Service Does

ResumeFitX is an AI-powered resume optimization tool. You upload a resume and a job description; we analyse keyword match and ATS compatibility, provide a score, and offer an AI-generated rewrite to improve your chances of passing Applicant Tracking Systems (ATS). The Service is provided for informational and productivity purposes only — it does not guarantee employment outcomes, interviews, or job offers.

2. Eligibility

• You must be at least 18 years old to create an account or make a purchase.
• Payments are processed in Indian Rupees (INR) via Razorpay. You must have a valid Indian payment method (UPI, netbanking, debit/credit card) to purchase credits.
• You must provide a real, working email address. Temporary or disposable email addresses may be blocked.
• One account per person. Creating multiple accounts to abuse free credits is prohibited and may result in permanent bans.

3. Account Registration & Security

You are responsible for keeping your password secure and for all activity that occurs under your account. Do not share your login credentials. If you suspect unauthorised access, contact us immediately at support@getresume.fit. We are not liable for losses arising from unauthorised account access due to your failure to keep credentials secure.

4. Credit System

• Free credits: New accounts receive 20 credits on signup (enough for 2 free ATS score checks). These are one-time — additional analyses require a paid plan.
• Credit costs per action: ATS analysis — 10 credits; Full AI rewrite — 30 credits; Chat refinement message — 10 credits; PDF download — 5 credits; DOCX download — 3 credits.
• Credits are non-transferable and tied to your account. You cannot transfer credits to another user or combine credits across accounts.
• Expiry: Starter plan credits expire 60 days after purchase; Pro plan credits expire 90 days after purchase. Expired credits are forfeited without refund.
• Credit costs and plan details may change. You will always see the current cost before confirming an action.

5. Payments & Billing

• All payments are processed by Razorpay (a RBI-licensed payment aggregator). We do not store your card number, CVV, or bank credentials — we never see them.
• Prices are listed in Indian Rupees (₹) inclusive of applicable GST.
• There are no subscriptions or recurring charges. You pay once per credit pack purchase. You will not be charged again unless you initiate a new purchase.
• A payment receipt is sent to your registered email address by Razorpay after each successful transaction.
• In case of a failed transaction where money was deducted from your account but credits were not added, contact us within 7 days at support@getresume.fit with your transaction ID and we will resolve it.

6. Refund Policy

Our refund policy is detailed at /refund. Key points:

• Download failure: Full refund of credits consumed if a PDF or DOCX download fails due to a technical error on our end.
• Unused credits within 7 days: If you have not used any credits from a plan (other than the free signup credits) and request a refund within 7 days of purchase, we will process a full refund.
• No refund on used credits. Once credits have been consumed for analyses, rewrites, or downloads, they cannot be refunded. You are always shown the credit cost before confirming an action.
• Refund requests must be submitted to support@getresume.fit with your registered email and order ID.

7. Acceptable Use

You agree not to:

• Upload resumes that do not belong to you, or use the Service to process documents on behalf of others commercially without our permission.
• Create multiple accounts to exploit free credits or circumvent any usage limits.
• Attempt to hack, scrape, reverse engineer, or disrupt the Service or its underlying infrastructure.
• Use the Service to process any content that is unlawful, harassing, defamatory, or violates any third party's rights.
• Resell, sublicense, or commercially redistribute AI-generated output as a service to third parties without our written permission.

Violation of acceptable use may result in immediate account suspension without refund.

8. AI-Generated Content & Disclaimer

• The AI rewrite is generated by Anthropic Claude, a third-party AI model. By using the Service, you consent to your resume and job description being sent to Anthropic's API for processing.
• The AI will only rewrite how your existing experience is described. It is instructed never to add companies, degrees, certifications, skills, or statistics that are not in your original resume.
• Despite these instructions, AI models can make errors. You must review all AI-generated content before submitting to any employer. We are not liable for inaccuracies in AI output.
• ATS scores are compatibility estimates based on documented ATS behaviour. They are not scores generated by any specific employer's actual ATS. A high score does not guarantee shortlisting.
• ResumeFitX makes no representation that using this Service will result in employment, interviews, callbacks, or any other specific recruitment outcomes.

9. Intellectual Property

• Your content is yours. You retain all rights to your resume and any AI-generated rewrite produced from your content. You are free to use, modify, and submit the rewritten resume to employers without restriction.
• Our platform. The ResumeFitX brand, website, application code, scoring algorithms, and prompt designs are our intellectual property. You may not copy, imitate, or commercially exploit them.
• Licence to process: By uploading your resume, you grant us a limited, temporary licence to process it for the purpose of providing the Service — nothing more.

10. Data, Privacy & Third-Party Services

Our full data practices are described in the Privacy Policy. Key points relevant to these Terms:

• Resume text is sent to Anthropic (USA) for AI processing. By using the Service you consent to this cross-border transfer.
• Generated files (PDF/DOCX) are stored on Cloudflare R2 (global CDN infrastructure). Files are automatically deleted after plan expiry (60 or 90 days).
• Authentication is managed by Supabase. Session tokens are stored in secure, httpOnly cookies — not accessible by JavaScript.
• We do not sell, rent, or share your personal data with advertisers or data brokers.

11. Service Availability

We provide the Service on a best-effort basis and do not guarantee 100% uptime. We may perform maintenance, updates, or experience outages beyond our control (including downtime from Supabase, Anthropic, Cloudflare, or Razorpay). We are not liable for losses arising from service unavailability. If a credit-consuming action fails due to our downtime, the credits will be refunded to your account.

12. Limitation of Liability

To the maximum extent permitted by applicable law:

• Our total aggregate liability to you for any claim arising from or related to the Service shall not exceed the total amount you have paid to us in the 3 months preceding the incident.
• We are not liable for any indirect, incidental, consequential, or punitive damages — including loss of employment opportunity, loss of data, or loss of income — even if we were advised of the possibility of such damages.
• We are not liable for the actions or output of third-party services (Anthropic, Razorpay, Supabase, Cloudflare) even where those services form part of our product.

13. Indemnification

You agree to indemnify and hold ResumeFitX and its operators harmless from any claim, demand, loss, or expense (including legal fees) arising from your violation of these Terms, your use of the Service in a manner not permitted herein, or any content you upload that infringes a third party's rights.

14. Account Termination

• By you: You may request account deletion at any time by emailing support@getresume.fit. Remaining credits are non-refundable upon voluntary deletion.
• By us: We may suspend or terminate your account immediately, without notice or refund, if we determine you have violated these Terms — particularly around account abuse, fraud, or creating multiple accounts.
• Upon termination, your stored files will be deleted within 30 days. Payment records required for tax compliance are retained for 7 years per Indian law.

15. Governing Law & Dispute Resolution

These Terms are governed by the laws of India, including the Information Technology Act 2000, the Consumer Protection Act 2019, and other applicable Indian statutes. Any dispute arising from these Terms shall first be attempted to be resolved amicably by contacting us at legal@getresume.fit. If unresolved within 30 days, disputes shall be subject to the exclusive jurisdiction of the courts of Delhi, India.

For consumer disputes, you may also approach the appropriate Consumer Forum under the Consumer Protection Act, 2019.

17. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you via the email address on your account at least 7 days before the changes take effect. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and may request account deletion.
